Brand Prize / Spin-to-Win Sweepstakes Rules
OFFICIAL RULES OF THE SYSTECH PACK EXPO (LAS VEGAS) “SPIN TO WIN” SWEEPSTAKES (THE “SWEEPSTAKES”)
THE SWEEPSTAKES IS OPEN TO LEGAL RESIDENTS OF THE UNITED STATES, THE EUROPEAN UNION AND WORLDWIDE WHO ARE 18 YEARS AND OLDER EXCEPT FOR RESIDENTS OF THE FOLLOWING COUNTRIES/PROVINCES: BRAZIL, CRIMEA, CUBA, IRAN, IRAQ, ITALY, NORTH KOREA, QUEBEC (CANADA), MYANMAR, SUDAN AND SYRIA AND ANY OTHER COUNTRY THAT IS RESTRICTED FOR BUSINESSES BASED IN THE UNITED STATES OR EUROPEAN UNION. NO PURCHASE OF GOODS OR SERVICES NECESSARY TO ENTER OR WIN. VOID WHERE PROHIBITED.
The Sweepstakes is sponsored by Sys-tech Solutions, Inc., 1 Research Way, Princeton, New Jersey 08540 (USA) (“Systech”). By entering the Sweepstakes, you are deemed to have read and agreed to the following terms and conditions (the “Official Rules”):
I. ELIGIBILITY. Employees or contractors of Systech, their family or household members, affiliates, and advertising or promotional agencies are not eligible to enter.
II. HOW AND WHEN TO ENTER. The Sweepstakes begins on September 23, 2019 at 7:00 a.m. Pacific Time (PT) and ends on September 25, 2019 at 7:00 p.m. PT. There are 3 ways to enter the Sweepstakes:
(A) Booth Entry: An individual may: (a) stop by Systech’s booth at the PACK EXPO trade show in Las Vegas (the “Booth”); (b) provide Systech with a business card or any writing with entrant’s name, business name, address, telephone number and email address; and (c) watch a short demonstration of Systech’s products and services. After watching the demonstration at the Booth, there will be a prize wheel for entrants to spin (the “Wheel”). By landing on the “Brand Prize” section of the Wheel, the entrant will be entered into a daily prize drawing.
(B) Postcard Entry: In advance of the PACK EXPO trade show, Systech will be mailing a postcard to a select group of 5000 individuals in or around the second week of September 2019 (each a “Postcard”). Each Postcard will have a barcode. Fifty of the Postcards will have “authentic” barcodes. Individuals who receive a Postcard may bring the Postcard to the Booth. If the Postcard scans as “authentic” in Systech’s UniScan application, then the individual will: (a) receive a “charge stick” with a retail value of approximately US$30; and (b) be entered into the drawing for the daily Brand Prize. All other individuals with Postcards will be permitted to spin the Wheel. By landing on the “Brand Prize” section of the Wheel, the entrant will then be entered into the daily prize drawing.
(C) Innovation State Presentation Attendance Entry: Systech will be handing out 75 promotional postcards (each a “Promo Card”) during the Systech presentation on the Innovation Stage on September 23, 2019. Each Promo Card will have a barcode. Five of the Promo Cards will have “authentic” barcodes. Individuals who receive a Promo Card may bring the Promo Card to the Booth. If the Promo Card scans as “authentic” in Systech’s UniScan application, then the individual will: (a) receive a “charge stick” with a retail value of approximately US$30; and (b) be entered into the drawing for the daily Brand Prize. All other individuals with Promo Cards will be permitted to spin the Wheel. By landing on the “Brand Prize” section of the Wheel, the entrant will be entered into the daily prize drawing.
(D) There is a maximum of one Brand Prize entry per person for the Sweepstakes. By entering the Sweepstakes, each entrant agrees to receive email and newsletter communications from Systech. However, entrant may withdraw this consent to communication at any time and/or entrant may opt out from receiving any specific communications simply by sending an email to marketing@systechone.com.
III. WINNING THE SWEEPSTAKES. On each of September 23, September 24 and September 25 one daily Brand Prize Winner will be selected in a random drawing from all eligible entries received. Winner will receive a US$300 Visa gift card (the “Prize”). Odds of winning depend upon number of entrants. Each daily Prize drawing will take place on or about 3:00 p.m. PT. Each drawing will be conducted by Systech or by an independent administrator at PACK EXPO. However, entrant need not be in attendance at PACK EXPO to receive the Prize. After the drawing, the Winner will be announced via social media and be notified by email. The Winner must respond within three (3) business days. The Prize will then be mailed to the Winner. Systech reserves the right to confirm eligibility of any Winner. In the event that the Winner is ineligible or does not respond, the Prize will be forfeited. Systech, in its sole discretion, will decide whether to award the Prize to another entrant.
IV. RIGHT TO CANCEL OR SUSPEND SWEEPSTAKES. If for any reason the Sweepstakes is not capable of running as planned for reasons such as tampering, unauthorized intervention, fraud, technical failures, calamities, force majeure or any other causes beyond the control of Systech that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, Systech reserves the right, at its sole discretion, to disqualify any individual(s) who tamper with the entry process, and/or to cancel, terminate, modify, or suspend the Sweepstakes provided that no change in these Official Rules shall be to the detriment of entrants . If Systech elects to cancel or terminate the Sweepstakes, Systech will not be responsible for any claim from entrants.
V. DISCLAIMER. Systech assumes no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorized access to Sweepstakes entries or entry forms; or alteration of entries or entry forms. Systech is not responsible for any problems with or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any e-mail entry to be received on account of technical problems or traffic congestion on the Internet or at any website, human errors of any kind, or any combination thereof.
VI. PRIVACY NOTICE. The European Union’s General Data Protection Regulation (“GDPR”) provides a number of protections for use of an individual’s personal data. Any personal data collected pursuant to the Sweepstakes shall be subject to Systech’s Privacy Policy located at www.systechone.com/privacy-policy and the GDPR.
VII. MISCELLANEOUS. Entrants shall: (a) be bound by these Official Rules; (b) accept decisions of Systech as final on all matters relating to the Sweepstakes. Except where prohibited by law, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant or Systech shall be governed by and construed exclusively in accordance with the laws of the state of New Jersey without giving effect to any otherwise applicable principles of conflicts of law. Entrant agrees that any action arising out of or relating to the Sweepstakes shall be brought in an arbitration proceeding before JAMS in its New York City office. Each entrant agrees that any and all disputes, claims, and causes of action arising out of or connected with the Sweepstakes: (a) shall be resolved individually, without resort to any form of class action; (b) in the event damages are awarded, such damages shall be limited to actual out-of-pocket costs but in no event attorneys' fees; and (c) under no circumstances will any entrant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses.
